Rules for withdrawing from a distance contract
The right to withdraw from the contract
You can resign from the purchase you have made in accordance with the following rules of withdrawal from a distance contract:
Subject to points 2-3 of these rules, in accordance with the "Act on consumer rights" (Journal of Laws 2014.827), the Consumer has the right to withdraw from the contract within 14 days (or more days if a longer period is provided on the offer page) from the date of taking up the products possession by the Consumer or a third party designated by him other than the carrier. When submitting a declaration of withdrawal from the contract, the Consumer does not have to provide a reason.
If the order is carried out in the form of one physical shipment, the deadline to withdraw from the contract expires after 14 days from the day on which the Consumer acquires, or a third party other than the carrier and indicated by the Consumer acquires, physical possession of the goods.
In the case of purchasing multiple goods that are delivered separately, the deadline for withdrawing from the contract expires after 14 days from the day on which the Consumer acquires, or a third party other than the carrier and indicated by the Consumer acquires, physical possession of the last item.
To exercise the right to withdraw from the contract, the Consumer must inform the Store about his decision to withdraw from this contract by an unequivocal statement by e-mail to the following address: kontakt @ coffeexpress @ .pl, by traditional mail to the following address: ul. Pękowicka 37/2 31-262 Kraków or by filling out the form on this page.
As a Consumer, you can use the model withdrawal form , but it is not obligatory.
In order to keep the deadline for withdrawing from the contract, it is enough to send information regarding the exercise of the consumer's right to withdraw from the contract before the deadline to withdraw from the contract.
Consequences of withdrawal from the contract
In the event of withdrawal from the contract, the contract is considered void. We will refund all payments made by you, including the cost of delivering the goods (except for additional costs resulting from the method of delivery chosen by you other than the cheapest standard delivery method offered by our store) immediately, and in any case no later than 14 days from the date on which we will be informed by you about the decision to exercise the right to withdraw from this contract.
We will refund the payment using the same method of payment as you used, unless you expressly agree to a different method of reimbursement that does not entail any costs for you.
We may withhold the reimbursement until we receive the item or until proof of its return is provided to us, depending on which event occurs first.
The consumer is obliged to return the item or hand it over to the person authorized to collect it immediately, but not later than 14 days from the date on which he withdrew from the contract, unless the Seller suggested that he will pick up the item himself. To meet the deadline, it is enough to return the items before its expiry.
The consumer bears only the direct cost of returning the item. The consumer is responsible for reducing the value of the item as a result of using it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the item.
